Participant Waiver and Release of Liability

• Open ocean activities carry risk. Swimming and snorkelling in the open ocean carry inherent risks, including but not limited to changing weather conditions, strong currents, high waves, and the presence of marine life, such as Whales, Dolphins and other potentially dangerous creatures.

• Marine animals can behave unpredictably. Swimming near Whales or Dolphins involves risks, including the potential for the animals to behave unpredictably, and close encounters with marine animals can result in serious injury.

• You are responsible for your own safety. You take full responsibility for your safety during the Retreat. You will only enter the water if you are a competent swimmer and snorkeller and are comfortable with the risks associated with these activities. You will follow all safety instructions given by the Company, its Skipper and crew.

• You are medically fit to take part. You are in good physical health and do not have any medical condition that would prevent you from participating in strenuous physical activity in the open ocean. You will disclose any medical conditions or concerns that may affect your safety, or the safety of others, in your Health, Medical and Swimming Declaration before the Retreat.

You voluntarily assume all risks associated with your participation in the Retreat.

This waiver and release of liability is binding on you, your heirs, executors, administrators and assigns, and is intended to be as broad and inclusive as permitted by the laws of the jurisdiction in which the Retreat takes place.

By completing your registration, you confirm that you have read this waiver, that you fully understand its contents, that you are aware you are giving up substantial legal rights, and that you accept it freely and voluntarily without any inducement.
